Describing Suleman alias Salman Siddiqui and Ravish as declared criminals, Chief Metropolitan Magistrate (CMM) Pushpam Pathak said, “I believe both the accused are deliberately avoiding appearing in court despite the procedure under Section 82 of the CrPC.”

The court has also taken cognizance of the charge sheet filed by the Delhi Police in the case. The court said, “There is sufficient evidence on record to take cognizance of the crimes committed by the accused.”

The court noted that although it was inclined to take cognizance of the offense under Section 153-A of the IPC, the previous sanction provided under Section 196 of the CrPC was mandatory, but was not filed by the prosecution agency. The investigating officer told the court that on 13 July a letter was sent to the competent officer, but it was not clear how long it would take for the approval.
